How overnights affect child support calculations in Oklahoma

0-120 overnights

Standard Calculation

Under 33% time

The noncustodial parent pays their full proportional share of the support obligation with no parenting time adjustment.

121-143 overnights

Parenting Time Adjustment

33-39% time

The combined obligation is multiplied by a factor (2 for 121-131 overnights, 1.75 for 132-143), then split by income share and offset, reducing the payment.

144-205 overnights

Higher Adjustment

39-56% time

A factor of 1.5 applies to the combined obligation before the offset. A parent with more than 205 overnights pays no child support.

Frequently Asked Questions

Common questions about Oklahoma child support

How is child support calculated in Oklahoma?

Oklahoma uses the income shares model under 43 O.S. § 118D and the Schedule of Basic Child Support Obligations codified in 43 O.S. § 119. Both parents' monthly gross incomes are combined and looked up on the statutory schedule to find a base child support obligation. That obligation is then divided proportionally based on each parent's share of the combined income. Oklahoma also applies a parenting time adjustment under 43 O.S. § 118E when the noncustodial parent has 121 or more overnights per year.

What counts as gross income in Oklahoma child support?

Gross income in Oklahoma includes income from all sources including wages, salaries, commissions, bonuses, self-employment income, dividends, severance pay, pensions, interest, trust income, annuities, Social Security benefits, unemployment benefits, disability insurance, workers' compensation, and spousal support received. Oklahoma courts may impute income to a parent who is voluntarily unemployed or underemployed.

How does parenting time affect Oklahoma child support?

Under 43 O.S. § 118E, a parenting time adjustment is available only when the noncustodial parent is granted 121 or more overnights per year (about 33% of the time). The combined base obligation is multiplied by a factor based on the overnight count: 121-131 overnights use a factor of 2, 132-143 overnights use 1.75, and 144 or more overnights use 1.5. The adjusted obligation is split by income share, each parent's share is multiplied by the percentage of time the child spends with the other parent, and the amounts are offset so the higher-owing parent pays the difference. A parent with more than 205 overnights pays no support, and the adjustment can never increase support above the amount owed without it.

Can Oklahoma child support be modified?

Yes, either parent can petition to modify child support when there has been a substantial and continuing change in circumstances. Oklahoma generally allows modification when the current order differs from the recalculated guideline amount by 20% or more, or by at least $25 per month. Common reasons include significant income changes, changes in parenting time, changes in childcare or medical costs, or a child aging out of the order.

How long does child support last in Oklahoma?

In Oklahoma, child support continues until the child turns 18. If the child is still regularly attending high school at 18, support continues until graduation or age 19, whichever comes first. Support may continue past 18 for a child with a disability that prevents self-support. Oklahoma courts generally cannot order parents to pay for college as part of child support.

Are childcare and health insurance included in the calculation?

Yes. Under Oklahoma's guidelines, work-related childcare costs and the cost of health insurance for the child are added to the basic child support obligation before it is divided between the parents. Each parent's share of these additional costs is proportional to their share of the combined gross income.

Is this calculator accurate for my situation?

This calculator provides an estimate based on the Oklahoma child support guidelines. Actual court-ordered support may differ because judges may deviate from the guidelines based on factors including the child's educational needs, extraordinary expenses, the financial resources of each parent, and the standard of living the child would have enjoyed. Consult an Oklahoma family law attorney for an accurate assessment.
