1. Introduction

Welcome to LegesGPT, operated by DEFUSE ML LLC, a company registered in Wyoming, United States ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our website, products, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

2. Use of Services

Our Services are designed to provide AI legal assistance across multiple jurisdictions. You understand and acknowledge that:

  • The information provided through our Services does not constitute legal advice and should not be treated as a substitute for professional legal counsel.
  • Our AI models generate content based on patterns and information available during their training and may not always be fully accurate.
  • You are responsible for verifying any information provided by our Services with appropriate legal professionals before making decisions or taking actions.

3. User Accounts

To access certain features of our Services, you may need to create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your account credentials.
  • Be solely responsible for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.
  • You must be at least 18 years of age to create an account and use our Services. By creating an account, you represent and warrant that you are at least 18 years old.

4. Acceptable Use

You agree not to use our Services for any unlawful or prohibited purpose. When using our Services, you must not:

  • Use the Services for any illegal activity or to violate any applicable laws or regulations.
  • Attempt to gain unauthorized access to any part of the Services, other accounts, or computer systems or networks.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Services.
  • Use the Services to harass, abuse, threaten, or intimidate any person.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Use automated means (bots, scrapers, etc.) to access the Services without our prior written consent.
  • Resell, redistribute, or sublicense access to the Services without our authorization.

5. Subscription and Billing

Some of our Services are offered on a subscription basis. By subscribing to a paid plan:

  • You agree to pay all fees in accordance with the billing terms in effect at the time of your initial subscription or renewal.
  • Subscriptions automatically renew at the end of each billing period unless canceled prior to the renewal date.
  • You authorize us to charge your designated payment method for all fees incurred.
  • No refunds will be provided for partial months of service or unused features.
  • In the case of a subscription downgrade, you will not receive a refund for the unused portion of your current subscription period. However, any unused credits or prepaid amounts will be applied to your next subscription period.

Free Trial Eligibility and Abuse

We offer a free trial to new users to evaluate our Services. This trial is limited to one per individual, household, or payment method. A small $1.00 USD activation fee is required to verify eligibility and is non-refundable and separate from any subscription charges.

  • To prevent abuse, we monitor usage patterns and payment methods. If we detect that the same payment method, account credentials, or other identifiers have been used to create multiple accounts, we reserve the right to immediately terminate the free trial and initiate billing for the subscription.
  • We use secure and anonymized methods to detect duplicate or abusive activity, including but not limited to tracking encrypted versions of payment card information.
  • By signing up for a free trial, you agree that we may take such measures to enforce fair use and prevent exploitation of our service.

6. User Content

Our Services may allow you to upload, submit, or store content ("User Content"). By submitting User Content, you:

  • Grant us a limited, non-exclusive, royalty-free license to use, reproduce, and process your User Content solely for the purpose of providing the Services to you. We will not share, sell, or distribute your User Content to third parties except as described in our Privacy Policy.
  • Represent and warrant that you have all necessary rights to upload such content and that the content does not violate any laws or third-party rights.
  • Acknowledge that you are solely responsible for the content you submit.

7. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the compilation thereof, are owned by us, our licensors, or other providers and are protected by copyright, trademark, and other intellectual property laws.

8. Privacy

Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and protect your information. By using our Services, you consent to the collection and use of your information as described in our Privacy Policy.

9. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. No advice or information obtained through the Services shall create any warranty not expressly stated herein.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Services, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless DEFUSE ML LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination:

  • Your right to access and use the Services will immediately cease.
  • We may delete your account and any associated data after a reasonable retention period, unless required by law to retain it.
  • Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved as follows:

  • Informal Resolution: Before filing any formal legal action, you agree to first contact us at contact@legesgpt.com and attempt to resolve the dispute informally for at least 30 days.
  • Arbitration: If the dispute cannot be resolved informally, it shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association (AAA), conducted in the State of Wyoming.
  • Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website or through other communications. Your continued use of our Services after such changes constitutes your acceptance of the modified Terms.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Wyoming, United States, without regard to its conflict of law provisions.
